nomoreforms™ provides electronic records that were previously required to be provided to you in writing.
The Electronic Signatures in Global and National Commerce Act (the E-Sign Act) provides that you must affirmatively consent to the use of electronic records, and you must not have withdrawn your consent, before nomoreforms™ may begin to provide and store your records in electronic form.
As part of a detailed opt-in procedure we would like to share the following information with you:
- You have the right to have the record made available on paper or in non-electronic form.
- You have the right to withdraw consent to the use of electronic records and any conditions or consequences that would thereby occur as a result of such withdrawal.
- Your consent applies to identify categories of records that may be provided in the course of the parties' relationship.
- To withdraw your consent, send a letter via certified mail to nomoreforms™ Inc., 5396 School Road, New Port Richey, FL 34652, asking for your data to be deleted from our database.
- To update your information return to this same web site and simply update your information on any form.
- You may copy any form at anytime without cost by opening a form and clicking the print button on your browser. If you do not have a printer available and would like paper copies of your forms, you may send us a list of the forms you would like copied and a check or money order for $2.00 per page and we will provide you your copies.
- The hardware and software specifications associated with accessing and retaining the electronic records are as follows: you must have a computer that can connect to the World-Wide-Web with an actual bandwidth of not less than 56,000 baud, must use Internet Explorer as the browser with a version 5.0 or greater and use Adobe Acrobat Reader version 5.0™ .
- If nomoreforms™ changes the hardware or software requirements for communicating electronically with us and if this change creates a risk that you could no longer access nomoreforms™ records electronically, then nomoreforms™ will: provide you with a statement detailing the changes to the hardware or software requirements;
- provide you with a chance to withdraw consent to the use of electronic records without the imposition of any fees for such withdrawal and without the imposition of any conditions not previously detailed; and
- obtain your consent, or confirmation of consent, either electronically, or in a manner, which reasonably demonstrates that you can access information in the modified electronic form.
- Failure to adhere to these procedures shall be treated as a withdrawal of consent upon election by you.
- The Electronic Signature Act expressly states that the legal effectiveness, validity or enforceability of any contract executed by you shall not be denied legal effect solely because of the failure to obtain electronic consent or confirmation of consent.
- Furthermore, if you withdraw your consent, the legal effectiveness, validity and enforceability of those electronic signatures or records provided or created prior to the withdrawal shall remain unchanged.
- Finally, your withdrawal of consent shall take effect within a reasonable period of time after receipt by nomoreforms™.
